1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Heyfield platform, including our website at heyfield.app, AI phone receptionist services, SMS notification features, call dashboard, and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
Heyfield is operated by Heyfield ("we," "us," or "our"). If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Description of Service
Heyfield provides an AI-powered phone receptionist for home service businesses. The Service includes:
- AI voice answering — an automated receptionist that answers inbound phone calls on your behalf, collects caller information (name, phone number, address, service needed, urgency level), and conducts natural conversations.
- SMS notifications — instant text messages sent to your designated phone number with a summary of each call, including caller details and urgency.
- Call dashboard — a web-based interface to view call logs, transcripts, summaries, appointment bookings, and manage your account settings.
- Smart forwarding — optional call forwarding that rings your personal phone first before the AI receptionist takes over.
- Appointment scheduling — AI-assisted booking based on your configured availability slots.
3. Account Registration
To use the Service, you must create an account and complete our onboarding process. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Each account is associated with a single business organization. You must not share account credentials or allow unauthorized access to your account.
4. Free Trial
Heyfield offers a 7-day free trial for new accounts. No credit card is required to start the trial. During the trial period, you have access to the full functionality of the Service within reasonable usage limits. We reserve the right to modify or discontinue the trial offer at any time.
5. Subscription Plans and Billing
After your free trial, continued use of the Service requires a paid subscription. We offer the following plans:
- Starter — $49/month, includes 150 minutes of AI call handling. Overage rate: $0.25 per additional minute.
- Pro — $99/month, includes 400 minutes of AI call handling. Overage rate: $0.20 per additional minute.
- Business — $199/month, includes 800 minutes of AI call handling. Overage rate: $0.15 per additional minute.
Subscriptions are billed monthly in advance via Stripe. Overage charges are calculated based on actual usage and billed at the end of each billing period. All fees are in US Dollars and non-refundable except as required by law.
We reserve the right to change pricing with 30 days' notice. You may upgrade, downgrade, or cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, including telecommunications laws (TCPA, STIR/SHAKEN) and telemarketing regulations.
- Make or facilitate robocalls, spam calls, or unsolicited outbound calls.
- Transmit threatening, harassing, defamatory, or fraudulent content through the Service.
- Impersonate another person or business, or misrepresent your affiliation with any entity.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Resell, sublicense, or provide the Service to third parties without our written consent.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
7. AI-Generated Content Disclaimer
The AI receptionist generates responses in real time based on your business configuration and caller input. While we strive for accuracy and professionalism, you acknowledge that:
- AI-generated responses may occasionally contain errors or misinterpretations.
- The AI does not provide pricing, estimates, medical advice, legal advice, or emergency services.
- Call summaries and transcripts are AI-generated and may not be 100% accurate.
- You are responsible for reviewing call summaries and following up with callers as appropriate.
Heyfield is not liable for any business decisions made based on AI-generated summaries or transcripts.
8. Call Recording and Transcription
The Service records and transcribes phone calls handled by the AI receptionist. By using the Service, you acknowledge and consent to this recording. You are solely responsible for compliance with applicable call recording laws in your jurisdiction, including but not limited to one-party and two-party consent requirements.
In jurisdictions requiring caller notification, the AI receptionist may include a disclosure in its greeting. However, it is your responsibility to ensure your use of call recording complies with all applicable laws.
9. Phone Numbers
Heyfield provides a dedicated phone number for your business as part of the Service. This number is provisioned through our telephony provider and remains the property of Heyfield. If you cancel your subscription, the phone number will be released and may be reassigned.
We make reasonable efforts to provision a number with your preferred area code but cannot guarantee area code availability.
10. Uptime and Service Availability
We strive to maintain high availability of the Service but do not guarantee 100% uptime. The Service depends on third-party infrastructure including telephony, voice AI, and cloud hosting providers. We are not liable for downtime caused by factors outside our reasonable control, including but not limited to internet outages, telephony provider issues, or force majeure events.
11. Intellectual Property
The Service, including its design, code, AI models, branding, and documentation, is owned by Heyfield and protected by intellectual property laws. You retain ownership of your business data, including call recordings, transcripts, and customer information stored in the Service.
You grant Heyfield a limited license to process your data as necessary to provide the Service, including training our systems to improve call quality. We will not sell your data to third parties.
12. Limitation of Liability
To the maximum extent permitted by law, Heyfield shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of business opportunities, or loss of data, arising out of or in connection with your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid to Heyfield in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Heyfield, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Termination
You may cancel your account at any time through the account settings or by contacting support. We may suspend or terminate your account if you violate these Terms or if required by law.
Upon termination, your access to the Service will cease, your phone number will be released, and your data will be deleted within 30 days unless retention is required by law. You may request an export of your data prior to termination.
15. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
